Terms and Conditions.

The organizer of the courses and training sessions is the AKADEMIA Ewa Wardęga training institution YourSPAce Ewa Wardęga, 86-050 Solec Kujawski ul. Żniwna 1 A, NIP 556-265-15-96.

These Terms and Conditions apply to contracts concluded via the website www.ewardega.pl, directly at the training venue, by telephone and by email.

Akademia Ewa Wardęga organizes courses and training sessions within the scope and on the dates described in detail in the course and training offer published on the website ewardega.pl. The current scope of the training offer used in delivering a course or training session, applicable on the day the course or training session takes place, is the one published on the website on the day the course or training session begins. The curriculum of a course or training session is not subject to any changes or claims.

Before the start of a course or training session, Participants are required to read these Terms and Conditions. Signing up for a training session via the Registration Form, or paying a deposit or the full amount for a course or training session, constitutes acceptance of the provisions of the Terms and Conditions.

Participants undertake to comply with generally applicable law and with the provisions of these Terms and Conditions from the moment payment is made, and in particular from the moment they begin attending the course or training session. While attending a course or training session, it is prohibited to provide any information that is unlawful, offensive or that infringes the personal rights of the instructors or participants of the course or training session.

Where a person is interested in a course at the Akademia Ewa Wardęga training institution, the course participant undertakes to pay a deposit (zadatek) as a booking fee, applied toward reserving a spot on the course, in the amount of 500 zł for each booked course or training session; the balance is payable 30 days before the start of the course. If the training is offered at a promotional price, payment of the full amount is required.

The deposit is part of the final price of the course. It is also an administrative amount, non-refundable if the Participant cancels the course for reasons beyond the Organizer's control or if the remaining payment is not made by the specified deadline. The above provision does not apply to bookings made less than 7 days before the planned start of the course, where payment of the full course amount is required, nor to bookings for a training session or a package of training sessions where payment of the full training amount is required, nor when the course price is reduced due to an ongoing promotion.

The payment gateway operator for electronic payments made to AKADEMIA Ewa Wardęga is T-Pay. All online transactions are processed securely in accordance with electronic payment security standards. By making a payment through the T-Pay gateway, the Participant accepts the terms and conditions of this payment operator.

Participants of all courses and training sessions organized by the AKADEMIA Ewa Wardęga institution declare that they will not record, reproduce, capture or distribute them in any form, in particular in the form of photographs or recordings. All training materials are the intellectual property of their creators, are protected by copyright and are made available to participants for private use only.

Violation of this prohibition is subject to a financial penalty of 50.000 zł (in words: fifty thousand złoty).

Training materials may not be sold, resold or made publicly available to persons not taking part in the courses or training sessions. This also applies to ONLINE courses.

AKADEMIA Ewa Wardęga reserves the right to produce, reproduce and edit videos, audio recordings, photographs, publications and any other materials related to the courses and training sessions conducted by the school as organizer.

Participants of all courses and training sessions organized by AKADEMIA Ewa Wardęga declare that they consent, free of charge, to the recording of their image or voice, in particular through being filmed and photographed, and to the subsequent publication of photographs and audio/video recordings from the courses or training sessions, and declare that they will have no claims in this regard.

Akademia Ewa Wardęga will use photos, audio/video recordings and other materials containing the image, likeness or voice of participants solely for promotional, marketing and image-building purposes or for the preparation of courses and training sessions. These materials become the property of AKADEMIA Ewa Wardęga. Persons downloading the shared files declare that they will not edit, modify or crop the photos.

Violation of this prohibition is subject to a financial penalty of 50.000 zł (in words: fifty thousand złoty).

By taking part in a course or training session, the Participant will receive certain knowledge covering the scope of the selected course or training session from the offer. This information will also be included in the educational materials provided to Participants electronically. Akademia Ewa Wardęga does not guarantee that Participants will achieve the results they intend in connection with the subject matter of the course or training session. The Participant is solely responsible for the way in which they use the methodologies presented to them, in particular for using them contrary to the trainer's instructions.

Promotions organized by AKADEMIA Ewa Wardęga, loyalty discounts, package discounts and other offers cannot be combined.

Persons who decide to take part in a course or training session of AKADEMIA Ewa Wardęga declare that they are healthy and have no contraindications whatsoever, including medical ones, to taking part in the training. AKADEMIA Ewa Wardęga has the right to refuse to conduct the training for a person who is ill, having regard to the well-being of the trainer and other students.

AKADEMIA Ewa Wardęga and its authorized representatives may ask a participant to leave the course or training session (with a refund of the money paid, less the administrative fee, i.e. the deposit, and the value of the partial participation in the training; this amount will be calculated in proportion to the planned length of the course or training session and the time during which the Participant took part). This applies in the case of repeated, regular inappropriate behavior by the participant, in particular if the Participant is ill, is under the influence of alcohol, drugs or other intoxicating substances, uses words commonly considered offensive towards the trainer or other Participants, disrupts the presentations of the trainer or other persons speaking during the training, and if, as a result, this disrupts the course or training session and has a negative effect on the training process of the whole group.

If, after the contract has been concluded and payment has been made, the Participant decides to change the date of their participation in the course, the funds paid may be used for a later date of the same course or transferred to another course or training session organized by AKADEMIA Ewa Wardęga, subject to the availability of spots, on the basis of a written statement and with the consent of AKADEMIA Ewa Wardęga.

A decision to transfer the paid deposit to another course or training may be submitted to AKADEMIA Ewa Wardęga in writing, i.e. by letter or by email, no later than 30 days before the originally scheduled course date. In the case of withdrawal submitted less than 30 days before the course date, or absence from the course, the deposit (reservation/administrative fee) will not be refunded.

The Organizer has set the maximum period for completing the course or training session at 12 months from the posting of the deposit payment. After this time, the posted funds will be deemed to constitute the provision of the service. Upon receiving electronic confirmation of the transfer of the deposit to a new course date, the Organizer will set a deadline for paying the remaining amount for the course, no later than 10 days from the setting of the new date.

A Participant who has registered for a course or training session may withdraw from it without giving a reason by informing the school of the cancellation, either by submitting an appropriate statement at the premises of the training institution or by sending the document electronically. Upon submitting the cancellation, the Participant loses student status, and the deposit or the promotional amount paid is non-refundable.

This paragraph applies exclusively to Camps organized by AKADEMIA Ewa Wardęga and, with regard to cancellation of participation in a Camp, takes precedence over §17. §16 and §17 apply to courses and training sessions that are not Camps.

Cancellation of participation in a Camp requires submitting an unambiguous statement to the Organizer in documentary form, in particular by email. The date of cancellation is determined by the day on which the Organizer receives the statement.

In the case of a cancellation submitted no later than 30 calendar days before the start of the Camp, the Participant covers the justified costs actually incurred by the Organizer and not recoverable by it that are directly related to the booking of their participation, but not more than 50% of the total price of the Camp.

In the case of a cancellation submitted later than 30 calendar days before the start of the Camp, or if the Participant does not show up, the Organizer may charge the Participant the justified costs actually incurred and not recoverable that are related to their participation, in particular the costs of accommodation, meals, booking of the spot and services ordered for the Participant, but not more than the total price of the Camp.

When determining the amount due, the Organizer takes into account the costs it avoided as a result of the cancellation, refunds received and the possibility of the vacated spot being used by another person. The Organizer provides the Participant with a statement of the costs incurred.

If the total of payments made by the Participant exceeds the amount due, the Organizer shall refund the difference within 14 days of determining it. If the total of payments is lower than the amount due, the Participant shall pay the difference within the time limit indicated in the cost statement provided to them, subject to the limits set out above.

The provisions of this paragraph do not limit the mandatory rights of the consumer, in particular the statutory right of withdrawal from the contract, where applicable.

AKADEMIA Ewa Wardęga reserves the right to cancel a course or training, in particular in the event of: illness or an unforeseen event affecting the person who was to conduct the training, resignation of the person conducting the training at a time that makes it impossible to replace them, changes to the schedule, loss of the right to use the premises where the training was to take place, or unforeseen events preventing the use of the premises (in particular fire, flooding, interruption of utility supplies, e.g. electricity, etc.).

In such a case, participants who have made a payment may choose either to take the same training on another date or to use the money for another training organized by the company. The Organizer does not reimburse any other costs incurred by the Student in connection with participation in the training, e.g. travel, accommodation, etc.

Persons purchasing services from AKADEMIA Ewa Wardęga declare that they consent to receipts, VAT invoices and corrected VAT invoices being sent electronically. Accordingly, persons who wish to receive a VAT invoice are obliged to provide this information before the training.

A person who wishes to receive a VAT invoice must give notice of this by email on the day of purchasing the course or on the day they pay for it. Otherwise, a receipt will be issued. If the course participant has provided a company Tax ID (NIP) in the training purchase form, an invoice will be issued automatically; otherwise, a receipt will be issued and cannot be changed.

The Participant who is a Student declares that they are aware that, in the case of trainings that break the continuity of tissue or skin (such as certain cosmetic treatments, permanent makeup, aesthetic medicine), working on models depends on a positive opinion of the instructor. The decision to allow work on models is made by the trainer, is final and is not subject to appeal. In the event of a negative opinion of the trainer, it is not possible to proceed with performing the treatment on a model. The Participant declares that they will not raise any claims against the Organizer on this account.

Trainings of the AKADEMIA Ewa Wardęga are conducted with the participation of models, or participants practice on one another, depending on the type of training. AKADEMIA Ewa Wardęga arranges the models itself.

A Participant who of their own free will decides not to perform treatments on models during a course or training is not entitled to perform those treatments on another date, nor to receive a certificate of completion of the training or certificates confirming their skills.

After a course or training has been completed with a positive result, AKADEMIA Ewa Wardęga issues two certificates: in Polish and in English. To obtain the above documents confirming their skills, the Participant must pass the exam. The exam is internal, and the decision on its form (written or practical) rests with the Instructor. AKADEMIA Ewa Wardęga has the right not to issue the above documents if the exam result or the instructor's opinion of the practical classes is negative.

If a treatment takes longer to perform than the time provided for in the course or training, the Participant is not entitled to additional training time. The length of the course or training is strictly fixed at the time the Participant signs up for it.

1. In the event of defects in the course or its non-conformity with the contract, the Buyer is entitled to file a complaint about the service by notifying the Seller by email at email: wardegaacademy@gmail.com
2. A complaint should include the following details:
   • first and last name
   • correspondence address (also the email address and phone number)
   • subject of the complaint
   • reason for the complaint
   • signature (only for complaints submitted by post)
3. Complaints will be considered by the Seller without undue delay, but no later than within 14 days of the date of receipt of the shipment with the goods complained about; the Seller will respond to the complaint submitted and inform the Customer of further steps. A complaint may be submitted 20 days before the start of the training, if the Student sees discrepancies in the offered training they have already purchased, or 7 days after the training has taken place. Complaints submitted at any other time will not be considered.
4. The Seller will inform the User of the outcome of the complaint at the email address provided in the complaint, and in the case of postal correspondence, at the address provided by the User.
5. If the complaint is accepted, the Seller undertakes to agree on a date for a replacement service or a refund of the course costs.
6. If the defect of the item sold is material, the consumer has the right to withdraw from the contract.
7. For Customers who are not consumers within the meaning of Article 221 of the Civil Code, the following services are not eligible for a refund:
   • purchased on promotion
   • completed courses confirmed with a certificate, opened online courses

The Student has the right to a refund for a purchased online training within 14 days of the date of purchase, or to withdraw from the contract, provided that the training content has not been used. If the Student has started using the content and wishes to obtain a refund, the Student has the right to withdraw from the contract after first providing a reasonable justification of the inconvenience or of the training not meeting their expectations; however, in such a case the Student loses the possibility of applying for the certificate confirming completion of the training.

A purchased online training is not refundable if it has already been played or if use of its content has begun.

Akademia Ewa Wardęga reserves the right to introduce promotions at any time without prior notice. If a training was purchased at the regular price before a promotion was introduced, we do not provide for a price adjustment or a refund of the price difference.

A purchased online training is valid for one year from the date of purchase. After this period, you may extend the validity of the training by paying an additional fee of 150 zł for each subsequent year of validity of each individual training. If you purchased a training package and wish to extend selected online trainings, the price must be multiplied by the actual number of courses being extended. Please remember that the validity of a training may be extended multiple times, subject to the conditions described.

In matters not regulated by these Terms and Conditions, the relevant provisions of Polish law shall apply, in particular the Civil Code, the Act of 18 July 2002 on the provision of electronic services, and other applicable provisions of Polish law.

The court competent to resolve any disputes related to the performance of contracts concluded on the basis of these Terms and Conditions is the court having subject-matter jurisdiction for the registered office of AKADEMIA Ewa Wardęga.

Akademia Ewa Wardęga stipulates that the main and only means of communication with participants is contact by email and telephone. Any information left on Messenger, in a comment under a post, or on the profiles of private individuals working at the Academy will be deemed non-existent.

The Participant of the training is bound by the above Terms and Conditions.
